1.1 These General Terms and Conditions (“T&Cs”) apply to all contracts between Alpine Ocean Industries GmbH, brand AOI-Luxusreisen, Chamerstrasse 172, 6300 Zug, Switzerland (hereinafter the “Organiser”) and its customers (hereinafter jointly the “Customer”).
1.2 The company specialises in the planning, organisation and delivery of individually arranged, high-quality and luxury trips, in particular to Thailand and the Maldives.
1.3 The travel services are arranged individually according to the Customer’s wishes. Depending on the trip, they may include in particular international and local flights, hotels, resorts, private villas, transfers, domestic flights, speedboats, seaplanes, yachts, private excursions, private guides, wellness services, special experiences and other tourist services.
1.4 These T&Cs apply in addition to the respective individual quotation, booking confirmation and the special travel conditions set out therein.
1.5 Individual written agreements between the Organiser and the Customer take precedence over these T&Cs.
1.6 Mandatory provisions of Swiss law remain reserved.
2.1 To the extent legally permissible, the contractual relationship is governed exclusively by the law of the Swiss Confederation.
2.2 Where the requirements of a package tour are met, the Federal Act on Package Travel (PRG, SR 944.3) applies in particular.
2.3 For matters not regulated, or not regulated conclusively, by the PRG, the provisions of the Swiss Code of Obligations (CO) apply in particular.
2.4 The mandatory provisions of Swiss law, in particular those of the Package Travel Act, the Code of Obligations, the Federal Act against Unfair Competition and the applicable data protection legislation, remain reserved.
3.1 Based on the Customer’s wishes and information, the Organiser prepares an individual travel quotation.
3.2 The quotation contains, to the extent known and possible at the time of preparation, in particular:
3.3 The travel contract is concluded as soon as the Customer binds themselves to the quotation or travel offer and the Organiser confirms the booking or makes a binding reservation of the services required for the booking with the respective service provider.
3.4 A booking is binding once the contract has been concluded.
3.5 Where, due to the Customer’s individual wishes, a service can be reserved with the service provider on a binding basis only after acceptance of the quotation, the Customer is obliged to make the required down payment or payment on time.
4.1 The Organiser plans the trip individually in line with the wishes communicated by the Customer.
4.2 The Customer is obliged to provide, completely and truthfully, all information relevant to planning and carrying out the trip.
4.3 This concerns in particular:
4.4 Costs and disadvantages arising from incorrect, incomplete or late information may be charged to the Customer, to the extent legally permissible.
5.1 The Organiser may arrange or sell both package tours and individual travel services.
5.2 Whether a specific booking counts as a package tour within the meaning of the Swiss Package Travel Act depends on the statutory requirements and not on the designation of the contract alone.
5.3 Where several travel services are combined into a package tour and the statutory requirements are met, the mandatory provisions of the Swiss Package Travel Act apply.
5.4 Where individual services are merely arranged, the contract may be concluded directly between the Customer and the respective service provider. In this case, the terms and conditions of contract and carriage of the respective service provider apply in addition.
5.5 The Customer is informed of the role of the Organiser or intermediary and of the essential conditions of the booked services.
6.1 The travel price owed for the specific trip results from the individual booking confirmation.
6.2 For package tours, the legally required price information is provided in accordance with Swiss regulations.
6.3 The travel price covers those services that are expressly listed as included in the individual booking confirmation.
6.4 Services not expressly mentioned are deemed not included.
6.5 Personal expenses, additional drinks and meals, gratuities, optional services, visas, personal insurance and comparable costs are not included in the travel price unless expressly included.
7.1 Upon binding booking, a down payment of 30 % of the total travel price is generally due.
7.2 The down payment is credited against the total price of the trip.
7.3 Due to special conditions of individual service providers, a higher down payment or full advance payment may be required for individual trips or travel services.
7.4 Such a deviating payment condition will be communicated to the Customer before the binding booking.
7.5 For particularly high-value individual services, in particular private villas, exclusive resorts, charter services, yachts, private transfers or non-refundable special fares, a higher advance payment may be required.
8.1 The remaining travel price must generally be paid in full no later than 30 days before the day of departure.
8.2 The decisive factor for compliance with the payment deadline is receipt of the amount owed by the Organiser.
8.3 For bookings made less than 30 days before the start of the trip, the entire travel price is generally due immediately or within the period stated in the booking confirmation.
8.4 For individual travel services, different payment deadlines may apply due to the conditions of the respective service provider.
9.1 If the Customer is in default of a payment that has fallen due, the Organiser may request payment from the Customer in writing and set a reasonable grace period.
9.2 After the grace period has expired without payment, the Organiser may assert the rights available to it under Swiss law.
9.3 Where the statutory requirements are met, the Organiser may in particular withdraw from the contract and claim the costs actually incurred as a result of the cancellation.
9.4 The Organiser is entitled to provide travel documents and further services only after full receipt of payment, to the extent legally permissible.
10.1 The Customer may generally cancel the trip before the start of the trip.
10.2 The cancellation must be made in writing. The date of cancellation is the date on which the corresponding notice is received by the Organiser.
10.3 Due to the individual and partly non-refundable travel services, costs arise in the event of cancellation.
10.4 Unless different special conditions have been agreed in the individual booking confirmation, the following cancellation costs apply:
| Date of receipt of cancellation | Cancellation costs |
|---|---|
| 91 days or more before departure | 20 % |
| 90–61 days before departure | 30 % |
| 60–31 days before departure | 50 % |
| 30–15 days before departure | 70 % |
| 14–8 days before departure | 85 % |
| 7–0 days before departure | 100 % |
| No-show | 100 % |
10.5 The above scale constitutes the contractually agreed cancellation compensation, unless special conditions have been agreed.
10.6 For individually arranged luxury trips, individual services may be non-refundable or only partially refundable already at the time of booking or at an earlier point in time.
10.7 This includes in particular:
10.8 Where demonstrably stricter cancellation conditions of the respective service provider apply to an individual service, these may be imposed on the Customer, provided they were communicated to the Customer before the contract was concluded.
10.9 In the quotation or booking confirmation, the Organiser points out special cancellation conditions, where these are known.
10.10 The Customer’s mandatory statutory rights remain reserved.
11.1 Where a refund amount arises as a result of a cancellation, it is refunded once the settlement with the respective service providers has been completed.
11.2 The refund is generally made within a reasonable period after receipt of the corresponding payments or credits from the service providers.
11.3 Non-refundable services are not refunded.
11.4 Where a service provider refunds only a partial amount, the amount actually received is passed on to the Customer, unless other contractual claims of the Organiser exist.
11.5 A double refund of amounts that have already been refunded by a service provider, an insurer or another third party is excluded.
12.1 For particularly exclusive individual trips, the general cancellation scale may be replaced or supplemented by special cancellation conditions.
12.2 This is permissible in particular where a service provider, due to the nature of the service, requires full or partial advance payment and does not refund it upon cancellation.
12.3 Such conditions must be communicated to the Customer in a suitable form before the binding booking.
12.4 The individual cancellation conditions form part of the booking confirmation.
13.1 Changes to the travel date, trip duration, accommodation, flight connection, room or villa category or other booked services count as rebookings.
13.2 Rebookings are possible only insofar as the service providers concerned permit them.
13.3 In the event of a rebooking, the following may arise:
13.4 These costs are passed on to the Customer insofar as they are actually incurred and legally permissible.
14.1 To the extent legally permissible and allowed by the respective service providers, the Customer may name a suitable substitute person.
14.2 The substitute person must meet all requirements applicable to the trip.
14.3 All actual costs arising from the change of person may be charged to the Customer.
15.1 For flight services, the fare and carriage conditions of the respective airline apply in addition.
15.2 Depending on the fare, flight tickets cannot be changed or cancelled after issue, or only to a limited extent or at additional cost.
15.3 In particular, special fares, business class and first class fares and individually issued flight tickets may be subject to special cancellation conditions.
15.4 In the event of a cancellation or rebooking, the costs actually incurred by the respective service provider are taken into account.
16.1 For hotel, resort and villa bookings, the conditions agreed with the respective service provider apply.
16.2 For luxury resorts and private villas, particularly strict cancellation conditions may apply due to limited availability.
16.3 Where such conditions are known at the time of booking, they are communicated to the Customer before the contract is concluded.
17.1 Transfers may be carried out in particular by vehicle, limousine, domestic flight, seaplane, speedboat, yacht or other means of transport.
17.2 The conditions of the respective service provider apply to these services.
17.3 Depending on the respective fare, changes or cancellations may not be possible or may be possible only at additional cost.
18.1 The Customer is responsible for holding the valid travel documents required for the trip.
18.2 This includes in particular a valid passport and, where required, visas, entry permits and other documents.
18.3 Within the scope of its statutory and contractual obligations, the Organiser informs the Customer of the essential entry requirements known to it.
18.4 Entry and visa requirements may change at any time. The Customer must check them again before departure.
18.5 If the Customer cannot travel because of missing, invalid or insufficient travel documents, this is generally treated as non-attendance attributable to the Customer, unless a mandatory statutory provision provides otherwise.
19.1 The Customer is responsible for informing themselves about the health requirements of the trip.
19.2 The Organiser does not provide medical advice.
19.3 The Customer is in particular responsible for the necessary medication, vaccinations and medical precautions.
19.4 Special health or physical requirements must be communicated to the Organiser in good time before booking if they are relevant to carrying out the trip.
20.1 The Organiser strongly recommends taking out cancellation and travel insurance with adequate cover.
20.2 For high-value individual trips, insurance is particularly recommended that also provides adequate cover in the event of substantial cancellation costs and medically necessary trip interruptions.
20.3 Taking out insurance does not release the Customer from the obligation to pay amounts due to the Organiser on time.
20.4 An insurance claim is handled between the Customer and the respective insurer, unless expressly agreed otherwise.
21.1 The Organiser endeavours to provide all agreed travel services as confirmed.
21.2 Changes to individual travel services may become necessary where this is required due to circumstances beyond the Organiser’s sphere of influence.
21.3 In the case of minor changes, there is generally no entitlement to a price reduction, insofar as the statutory requirements for such a claim are not met.
21.4 In the case of material changes, the mandatory statutory provisions apply, in particular those of the Swiss Package Travel Act, where applicable.
21.5 The Organiser will inform the Customer of material changes as early as possible.
22.1 After conclusion of the contract, the agreed travel price may be adjusted only within the limits of what is legally permissible and a corresponding contractual agreement.
22.2 Permissible changes may arise in particular from changes in certain transport costs, levies, fees or exchange rates.
22.3 The Organiser informs the Customer of any price change and its basis.
22.4 The Customer’s mandatory statutory rights remain reserved.
23.1 To the extent Swiss law permits, the Organiser is not liable for the consequences of events that lie outside its sphere of influence and could not be prevented or averted despite reasonable care.
23.2 These may include in particular:
23.3 For package tours, the Customer’s mandatory statutory rights remain unaffected.
24.1 If the Customer notices during the trip that an agreed service is not being provided in accordance with the contract, they must notify the Organiser or the designated contact person without delay.
24.2 The Customer must give the Organiser or the service provider a reasonable opportunity to remedy the situation, where this is reasonable.
24.3 Where possible, the Customer should document complaints, for example with photos, written confirmations or other suitable evidence.
24.4 The Customer’s statutory claims remain reserved.
25.1 The Organiser is liable under the mandatory provisions of Swiss law for the services it owes.
25.2 For package tours, the special liability provisions of the Swiss Package Travel Act apply.
25.3 For services provided exclusively by independent third-party providers, the statutory provisions and the applicable conditions of the respective service provider apply.
25.4 A limitation of liability applies only insofar as it is permissible under Swiss law.
25.5 The mandatory statutory liability provisions apply to personal injury.
26.1 If the Customer does not appear at the scheduled start of the trip without having properly cancelled the trip beforehand, this counts as a no-show.
26.2 In the event of a no-show, up to 100 % of the travel price may be owed, insofar as this is permissible on the basis of the agreed conditions and the costs incurred.
26.3 Unused travel services are generally not refunded, unless a refund is made by the respective service provider or a statutory entitlement exists.
27.1 If the Customer voluntarily terminates the trip for personal reasons, there is generally no entitlement to a refund for unused services.
27.2 Additional costs of an early return journey are borne by the Customer, unless the Organiser must bear them on the basis of a statutory obligation.
27.3 In the event of a trip termination for an insured reason, the Customer can assert their claims against their travel insurer.
28.1 The Organiser processes personal data in accordance with the provisions of the Swiss Federal Act on Data Protection (FADP).
28.2 Personal data may be transmitted to airlines, hotels, resorts, transfer companies, local partners, authorities and other service providers insofar as this is necessary for preparing and carrying out the trip.
28.3 Any further processing takes place in accordance with the Organiser’s separate privacy policy.
29.1 The Customer agrees that communication in connection with the trip may generally take place by email, unless statutory written form is required.
29.2 The Customer is obliged to provide the Organiser with a current email address and telephone number.
29.3 Changes to contact details must be communicated to the Organiser without delay.
30.1 Complaints should be reported as promptly as possible during the trip so that a remedy can be provided.
30.2 Complaints submitted after the trip must be submitted in writing and should contain as precise a description of the facts as possible as well as any available evidence.
30.3 Statutory limitation and preclusion periods remain reserved.
31.1 For disputes arising from the contractual relationship, Swiss law applies, to the extent legally permissible.
31.2 The place of jurisdiction is determined by the mandatory provisions of Swiss law.
31.3 Where a jurisdiction agreement is legally permissible, the registered office of the Organiser is agreed as the place of jurisdiction.
31.4 Mandatory places of jurisdiction in favour of consumers remain expressly reserved.
32.1 Should a provision of these T&Cs be or become wholly or partly invalid, void or unenforceable, the remaining provisions remain unaffected.
32.2 The invalid provision will, to the extent legally permissible, be replaced by a provision that comes as close as possible to the economic purpose of the original provision.
33.1 No provision of these T&Cs restricts the Customer’s mandatory statutory rights.
33.2 In particular, the mandatory provisions of the Swiss Package Travel Act, the Code of Obligations, data protection law, the Federal Act against Unfair Competition and other applicable Swiss laws remain reserved.
These T&Cs enter into force on 1 October 2026 and apply to all contracts concluded from that date.
